Proposed Settlement with Woman Who Slipped During MARTA Plaza Construction
Decatur Metro | September 21, 2009 | 11:37 amAccording to tonight’s city commission agenda, the commission is scheduled to authorize the City Manager to enter into a settlement agreement with Majel Cottell, who sued both the MARTA plaza contractor and the city after she slipped and fell on some temporary fencing during construction in 2006.
Co-defendent Archer Western will pay Ms. Cottell $45,000 to settle the case. Pursuant with the construction contract between the city the Archer Western, the contractor has paid all legal fees associated with the case.
In other words, “the city is required to pay nothing.”
Being that I’m a DC gal, we pretty much walk everywhere we go. I also have a dog, so i walk her as much as possible, so basically my feet are my car. In my 31 years of life i have taken a few tumbles, i would say most of the time it’s because i’m not watching where i’m going. You don’t generally expect something to be in your way, but sometimes, things are.
I hope that she is ok and well, but I think 45k is extreme.
Just sayin..
Wow. Maybe I should perform a slip-down (in another city of course).
