Apparently a Massive Tree Fell on Fairview Ave Last Night
Decatur Metro | June 16, 2011A little late with this, but Kathy just pointed out this CBS Atlanta video and story from noon today that showcases the clean-up of a enormous tree that fell across Fairview Avenue during last night’s storms.












I’m pretty sure I heard the pop–I went to bed early and listened to part 1 of the storm. What I thought was an unusually large crack of thunder was probably this tree cracking. The men in the family were watching ?hockey?, didn’t notice, and acted like I was a scaredy cat.
I heard that crack, too, but judged its location as being across the creek, in the vicinity of Vidal.
This tree fell around the corner from us.
Just curious – if a neighbor’s tree falls in your yard and crushes your fence, are they responsible for it? Anyone know how this works?
If I remember correctly from my tree dropping a huge limb in our neighbor’s yard, the property owner (not the tree owner) is responsible. So if your neighbor’s tree falls on your fence, your insurance would have to cover it. You would probably have to sue to get reimbursed.
Any law, real estate or insurance types out there who can verify my assumptions?
By the way, because I’m a heck of a nice neighbor, I cut up and removed the limb.
Unless your neighbor was negligent in their maintenance of the tree, a point that’s fairly hard to prove, it’s your responsibility and your insurance would cover it. If your insurance carrier thinks the neighbor might be liable, they would take action to recover their loss.
