      According to Amanda Thompson of the CoD:

      “We anticipate that construction will begin on the 315 West Ponce site within the next 10 days. They will build the parking garage first, then the building in the front of the site, then the apartments in the rear of the site. The apartments would open sometime in Winter 2014.”

      Winter 2014, huh? Wow. That’s pretty quick! So, I’m guessing the 335 West Ponce neighbors’ suit hasn’t affected this project…

        ‘Winter 2014′ could mean Jan-Feb 2014 or Dec 2014. If they mean Jan-Feb and don’t complete it by then they could say that they meant Dec all along!

      The suit was settled a week or so ago. Among the agreements: the removal of one level of the parking deck, an allowance for screening the deck, a 5 year tree maintenance plan for the redwoods, no construction work on holidays, some considerations on how the top parking deck will be lighted and maybe a few other items.

        Some of parking will be underground and that will increase costs to developers. It will also improve the appearance for everyone as well as the additional screening. Developers were over a barrel and couldn’t move without concessions to neighbors.

          You are not correct. Per the terms of the settlement, however, (oops, Mr. Boykin!) you can’t be publicly corrected, and details cannot be elaborated on.

      You know, when TJ’s finally does establish a Decatur location, we’ll have to declare an annual festival to mark the date — and hold a “find a new snarky joke” competition.

      So it sounds like the suit had merit after all. And it sounds like the final project is better than it would have been without the suit. Developers may pocket a little less…or maybe not, because the project has a little more class.

        Merit’s debatable, but it did provide leverage. What’s important is that people generally ended up with something they could live with so we can finally get on with it.

          I guess the people who filed the suit got something they can live with. The rest of us now have no idea about the “maybe a few other things” that Mr Boykin mentioned. I have concerns that these “other things” in the settlement may not necessarily be in the best interest of the entire neighborhood .

          I understand that confidentiality agreements are the way it works with this type of lawsuit, but it doesn’t feel right to me.The people who were involved in this lawsuit were very vocal during the public input process about the lack of transparency shown by the City. Then they hired lawyers and went behind closed doors to push their demands. What happened to the need for transparency?
